Terms and Conditions Governing the Use of Parking Facilites

Part I – Preliminary
For the purpose of the terms and conditions, unless the context otherwise stated: -

    (a) ‘Car Park’ - shall mean the car park applied for in the application form overleaf.
    (b) ‘Client’ - shall mean person(s) using the Car Park.
    (c) ‘Agent’ - shall mean Owner’s authorized representative who is responsible for the management of the Car Park.
    (d) ‘Season Access’ - shall mean the IU number of the Client’s vehicle that will be entered in the database who has been granted season parking facilities in the stipulated Car Park.


Part II – Terms and Conditions
1.0 Season Parking
1.1 Client shall pay promptly all charges, levies and fees as determined by the Agent for use of the Car Park.
1.2 For season parking facilities, payment shall be made monthly or up to 3 months in advance.
1.3 Application for use of the season Car Park facilities shall be made using a prescribed form obtainable from the Agent’s office and shall be directed to the agent who has the absolute discretion to approve or disapprove any application. Upon approval, the Season Access will be granted upon payment of the appropriate charges, levies and fees as determined by the Agent.
1.4 Application for renewal of the Season Access must also be made on a prescribed form obtainable from the Agent’s office and must be made seven (7) days before expiry of the current season parking period. If the application for renewal of the Season Access and the appropriate payment are not made by the last day of the validity period, it is deemed that the Client does not require the season parking facilities anymore. Accordingly, the Season Access will be invalidated and the season parking facilities shall be granted to another party. Upon successful payment of the appropriate charges, levies and fees as determined by the Agent, the current Season Access will be renewed and shall continue for use.
1.5 The Agent reserves the right to terminate any season parking facilities with a given notice of one (1) month.
1.6 It is therefore important that application for renewal of the Season Access Pass and the appropriate payment are made promptly.
1.7 In the event of the client failing to renew the Season Access within the prescribed period, the Season Access will be invalidated and the Client will have to pay the hourly and/or per entry rate whichever is applicable for using the Car Park facilities. If the Client, subsequently, applies for renewal of the Season Access and the application is approved, the Client shall not be given any refund of any monies paid for using the Car Park prior to the season renewal. In addition, the Client shall also take note that notwithstanding the Season Access is renewed for a period of less than one month or quarter owing to late renewal of Season Access, the Client is required to pay for full charges, levies and fees for the month or quarter.
1.8 The Agent may also at its absolute discretion require the Client to place a security deposit of a sum of money as determined by the Agent from time to time for the due performance and observance of all the terms and conditions contained herein. If the Client should default in performing or observing any of the terms and conditions contained herein, the said security deposit shall be forfeited by the Agent without prejudice to the rights of the Agent to recover all monies which may become due or payable by the Client under the terms and conditions contained herein.
1.9 The Client issued with Season Access shall inform the Agent immediately of the following in writing or using a prescribed form obtainable from the Agent’s office: -
    (a) Any changes in the In-Vehicle (IU) and/or registration number of the Client’s vehicle.
    (b) Any change of vehicle/s by the Client.

In the event of paragraph of 1.9 (a) and (b) occurring, the Client shall seek the Agent’s consent for the Season Access to be transferred to the replacement vehicle. The Client is responsible for the safe custody of the Season Access issued to the season vehicle.


2.0 Season Access is strictly non-transferable except with the Agent’s written consent.
2.1 In the event of any abuse, the Season Access with the security deposit will be forfeited and/ or the holder will cease to enjoy the facility of the Car Park.


3.0 General
3.1 The Car Park operation hours and prevailing charges, levies and fees for use of the Car Park are displayed on the signboard at the Car Park entrance. The Agent reserves the right to vary the operation hours, charges, levies and fees at its absolute discretion from time to time without notice.
3.2 The Agent shall not be held liable for any expense, cost, loss, damage, theft or injury of whatsoever nature and howsoever caused to the Client, the employees, servants, visitors, agents or their vehicles (including their contents) or any other property in the Car Park. The client and any other persons using the Car Park do so entirely at their own risk.
3.3 The Client shall indemnify and keep the agent indemnified of all cost, expense, loss, damage, theft or injury of whatsoever nature and howsoever caused to property, vehicles and/or persons by the Client’s employees, visitors, servants, agents and/or vehicles.
3.4 There shall be no washing and repairing of cars, scooters, motorcycles, bicycles, trucks or vehicles of any kind in the Car Park.
3.5 The Agent reserves the right to remove any vehicles found causing obstruction or parked improperly in the Car Park. The Agent shall not be held liable for any loss or damage to the vehicle or its content as a result of its action.
3.6 The Agent reserves the right to evict or exclude the Client from the Car Park and forfeit all payment made in relation to the use of the Car Park in the event of:-
    (a) The Client fails to observe road courtesy, drives in a dangerous/reckless manner, parks improperly or causes obstruction or inconvenience to other users in the Car Park.
    (b) The Client fails to conduct himself/herself in a peaceable manner.
    (c) The Client fails to observe the traffic signs or other regulations in the Car Park.
    (d) The Client breaches or fails to fulfill any of the terms and conditions contained herein.
3.7 The Agent reserves the rights to delete, add, amend or vary any of the terms and conditions contained herein at the Agent’s discretion without notice.
